1. Introduction

The protection and security of personal data are of utmost importance to Neodent (Straumann Group). We collect and process personal data in compliance with data protection and privacy laws and regulations, such as the LGPD (Brazilian General Data Protection Law – Law No. 13,709/2018), the Brazilian Internet Bill of Rights (Law No. 12,965/2014), and the GDPR (General Data Protection Regulation of the European Union).

We always act with sensitivity and great care in order to preserve our relationship of trust.

It is important to us that you are aware that personal data are collected when you visit our website and when you use our services or offers. We also want you to be aware of how we use this data. Our Privacy Policy provides information on the use and protection of your personal data by the Straumann Group, its subsidiaries, and business partners, against manipulation, loss, destruction, or improper use.

2. Are your data sufficiently secure?

We take technical and organizational security measures to protect your stored personal data against manipulation, loss, accidental or intentional destruction, or access by unauthorized persons. These measures are intended to ensure the confidentiality and integrity of your data, as well as to continue ensuring the availability and resilience of systems and processing activities. Our security measures include data encryption, firewalls, and password protection. In addition, our data processing and security measures are continuously improved in line with new technological developments. Please note, however, that you are solely responsible for the proper use of security devices (e.g., antivirus software) when accessing our websites and services, in order to prevent unauthorized access by third parties.

3. How do we use your personal data?

“Personal data” refers to any information that identifies or can be used to identify you personally, such as your name, address, telephone number, email address, or billing details. We may collect and process personal data only if permitted by law or if you have given prior consent.

We will process and store your information for as long as required by law or until the purpose for which it was collected has been fulfilled. In cases where the right to revoke, cancel, or delete your data applies, please refer to Sections 7 and 10 below.

Our processing of your personal data depends on your interaction with us and requires your consent and/or a legal basis and may include the following cases:

a. Contact and information requests

We use your personal data to process and respond to your contact and information requests.

b. eShop and/or purchase registration

We use your personal data for registration in our eShop and/or purchase registration, to process your orders, as well as for billing and shipping.

The data collected for this purpose include: business data (legal entity name, address, CNPJ, State Tax Registration); personal data (first name, last name, ID number, CPF, address, professional registration, date of birth); copies of documents (ID, driver’s license, professional registration, proof of address); prescription information (patient’s full name; delivery address); financial (banking) data; records of purchased items; records of customer service interactions; records of interactions with the Ombudsman; records of interactions with the Whistleblower Channel; sent and received emails.

These data may be processed and shared with our production partners and for the transportation of the products ordered by you, as well as to provide support regarding your product-related questions.

c. Continuous improvement of our products and services

Your personal data may be used to improve our purchasing channels, enhance your customer experience, and address your product-related questions.

d. Online and offline marketing

We may inform you about our products, services, courses, events, and customer satisfaction surveys in the field of dentistry. We may also carry out customer analysis, which may include combining data received from you offline and online, in order to provide you with personalized information, such as courses, events, and customer satisfaction surveys that may be of interest to you in the dental field.

Occasionally, and only after your consent, authorized technological tools (cookies, etc.) may be used to confirm identity, personalize access and user experience, and track usage, always aiming to improve navigation, security, and customer functionality.

e. Registration for courses, events, and lectures

We use your personal data to register you for courses and events of interest to you, provided that you have given prior consent. Where applicable, details may also be processed by our cooperation partners for the execution and organization of courses and events.

The data collected for this purpose include: first and last name; CPF; professional registration (CRO); email; telephone number; street address; neighborhood; city and state; postal code; education level and specialization.

The information provided for this purpose must be expressly consented to by you, including the option to immediately discontinue the use of such data for this purpose.

f. Online job vacancies

When you apply for a job vacancy, training opportunity, or internship with us, we use and process your personal data, such as full name, education, address, email, telephone number, and application data, in order to process and evaluate your application and to contact you.

g. Compliance with regulatory obligations

In our role as a legal manufacturer of medical devices, we comply with a number of global laws, regulations, and standards aimed at ensuring high levels of patient health protection and high standards of quality and safety for medical devices. In this context, to ensure the safety, quality, and effectiveness of our products, we comply with the following non-exhaustive obligations: obtaining regulatory authority approvals; tracking, monitoring, and reporting adverse events; conducting clinical tests and evaluations; performing post-market clinical follow-up; reporting and vigilance processes; maintaining quality management systems and quality complaint processes. Data subject consent may be required where applicable, in accordance with current legislation.

In addition, we may conduct scientific research, product development, and clinical evaluations in compliance with applicable laws and regulations and ensuring proper documentation and necessary information.

h. Statistical purposes

After the legal retention period and necessity have ended, your personal data will be deleted using secure disposal methods or used in an anonymized manner for statistical purposes (Article 5, III and Article 12 of the LGPD).

i. Artificial intelligence

The use of Artificial Intelligence (“AI”) enabled features is entirely optional, and you will be notified when such features are available in our services; these functionalities are provided for your benefit and convenience.

Some of our features may collect data such as verbal or written communication between you and our virtual assistant in order to respond to questions and clarify doubts quickly and efficiently.

Data provided during interactions may be used in an anonymized manner to improve the performance and effectiveness of our features. Additionally, such data may be used for audits and compliance checks, ensuring the quality and security of the services provided.

We recommend that confidential or personal information, whether your own or third parties’, such as contact details, account numbers, or any other information that identifies an individual, not be included in AI-enabled features, and that you carefully review all AI-generated results before using them.

4. Patient Data

Certain services provided by us, such as orthodontic treatments, require the provision of patient data. We process any personal data provided securely and with due care, as described in Section 3 above or otherwise described in this Privacy Notice. We ask that you provide personal data only when necessary.

Unless otherwise agreed, you are considered the controller of the healthcare services and treatments you provide and prescribe to your patient. You warrant that, where and when legally required, you have obtained the appropriate patient consent for the treatment and provided adequate data protection information.

5. Required information

If a data collection form contains data fields marked as mandatory or with an asterisk (*), the provision of such information is required by law, by contract, or may be necessary for entering into a service contract or achieving the intended purposes. Failure to provide the required information may result in our inability to perform the contract or provide the requested service, or the stated purpose may not be achievable.

6. With whom do we share your data?

Your personal data may be shared with third-party service providers, suppliers, and other cooperation partners used by the Straumann Group for processing orders, transporting and delivering products, and managing course and event registrations. Your personal data may also be shared with third parties providing support services to the Straumann Group, including but not limited to printer maintenance, printing services, call centers, advertising agencies, internet providers, IT service providers, and data centers. In addition, we may share your information with other subsidiaries and/or affiliates of the Straumann Group, particularly for support, unified registration, processing, supply, or marketing purposes.

Our service providers, suppliers, and cooperation partners may only process your personal data for our purposes. Any sharing of personal data with third parties and affiliates is subject to compliance with our privacy policy and confidentiality terms.

7. Your right to object to processing

You have the right to object to the processing of your personal data by us; however, objecting may result in certain services and solutions becoming unavailable. We are committed to processing the minimum amount of personal and sensitive personal data necessary to meet legal and applicable requirements or rights.

8. Cookies and web tracking

a. Cookies

Cookies are small files sent to your computer’s hard drive using your web browser or other programs. They are stored locally on your computer’s hard drive and are available for later retrieval.

b. Use of cookies

Cookies are used on Straumann Group websites to:

  • facilitate and ensure technical functions;

  • make our website easier to use;

  • meet your needs or evaluate visits to our website for marketing and optimization purposes.

9. Google Analytics

When you click or close the consent banner, our website will use Google Analytics, a web analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses cookies stored on your computer to analyze your use of our website. The information generated by the cookies is generally transmitted to a Google server in the USA and stored there.

If IP anonymization is activated on the website, your IP address will be shortened by Google within EU Member States or other parties to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.
